Welcome to StorageSpot+ (“StorageSpot+”, “we”, “us”, “our”). These Terms and Conditions (“T&C”) govern your use of our website, online portal, and related services (collectively, the “Services”). By accessing or using our website or Services, you agree to be bound by these T&C. If you do not agree, please do not use our website or Services.
These T&C are in addition to, and do not replace, your signed StorageSpot+ Tenant Agreement (the “Agreement”). If there is any conflict between these T&C and your Agreement, the Agreement will control with respect to your storage unit and tenancy.
1. Eligibility
By using our website or Services, you represent and warrant that:
You are at least 18 years old, or you have the consent of a parent or legal guardian;
You have the legal capacity and authority to enter into binding agreements;
Your use of the website and Services complies with all applicable laws and regulations.
If you use the Services on behalf of a business or other entity, you represent you are authorized to accept these T&C on its behalf.
2. Services Provided
StorageSpot+ provides self-service storage facilities at 522 Isaacks Rd, Humble, TX 77338, where customers (“Tenants”) may rent storage units for the storage of personal property.
Rental Terms: All storage rentals are governed by a separate written Agreement. All rentals are subject to approval and a signed Agreement.
Facility Improvements: Facility descriptions (such as upgrades or repairs) are for information only and do not create any warranty or guarantee beyond what is expressly stated in your Agreement.
Relocation: Management reserves the right to relocate you to a comparable unit upon reasonable notice for operational, maintenance, or safety reasons, as described in your Agreement.
3. Payment Terms
Rent Due Date: Rent is due on the 1st day of each month.
Grace Period & Late Fees: Payments made after the 5th day of the month incur a $20 late fee. After the 5th day, an additional $10 late fee will be added per week until full payment is received.
Payment Methods: Payments are accepted only via credit or debit card through your online portal on the StorageSpot+ website.
Market-Based Pricing: Rental rates may change over time based on market conditions and other factors. Management may adjust rent or other charges by providing at least 30 days’ prior written notice.
Non-Payment & Lien Rights: Continued non-payment may result in loss of access, lockout, and enforcement of Management’s lien rights under Texas Property Code Chapter 59, including potential sale or auction of stored property after required notices.
4. Security Deposit
New Tenants (Effective January 1, 2026): A $150 security deposit is required at move-in, in addition to first month’s rent.
Deposit Refund: The deposit is refundable within 30 days of termination, provided the unit is left clean, empty, undamaged, the lock is removed, and all terms and amounts due are satisfied.
Deductions: Management may deduct unpaid rent, fees, cleaning, trash removal, lock replacement, or repair costs beyond normal wear and tear. Any remaining balance will be returned to your last provided address or email.
5. Use of Storage Units & Facility Rules
Storage-Only Use: Units are for storage only. No habitation, sleeping, working, loitering, or operating a business, gym, or workshop is permitted on the premises.
Prohibited Items: No hazardous, toxic, or flammable materials; illegal drugs or contraband; explosives; perishable food (except sealed, non-perishable items); live animals or plants; vehicles, trailers, or boats; or any item in violation of law, insurance, or safety requirements.
Trash & Cleanliness: You are responsible for your own trash disposal. Any dumpsters or trash containers provided are for move-ins and move-outs only. No ongoing trash or abandoned items allowed; removal will be at your expense.
Facility Rules: By using the facility, you agree to comply with all current and future rules as updated by Management. Rules cover access, conduct, speed limits, security, use of units, authorized contacts, and more. Updated rules will be posted or sent to you, and continued use after notice constitutes acceptance.
6. Access Hours & Security
Standard Access: 7:00 a.m. – 7:00 p.m., seven days a week, unless otherwise posted.
24/7 Access: May be granted at Management’s discretion and can be revoked for safety or policy reasons.
Security: The facility is monitored by cameras, gates, and lighting for deterrence only and not as a guarantee of safety or security. Management does not warrant uninterrupted operation of any security system.
Entry: Only authorized tenants and registered vehicles (if any) may access the property. Sharing your access PIN or allowing unauthorized entry is strictly prohibited.
7. Management’s Right to Enter
Management may enter your unit (with or without notice) in case of emergency, safety or legal concerns, maintenance and repair, or lien enforcement/default, as allowed by law and the Agreement. When possible, Management will secure the unit after entry.
8. Insurance & Liability
No Insurance Provided: Management does not provide insurance for your stored property. You store all property at your own risk and are strongly encouraged to obtain your own insurance.
No Bailment: Management is not a bailee or warehouseman and does not take custody of your property.
Indemnification: You agree to indemnify and hold harmless Management and its affiliates for any claims or losses arising from your use of the unit, the acts of your guests, or your breach of these terms or applicable law.
Website Use: We do not guarantee that our website or portal will be uninterrupted, error-free, or secure.
9. Default & Remedies
Default: You are in default if you fail to pay rent or other charges, violate any term of the Agreement, or use the unit for illegal or prohibited purposes.
Lien & Sale: After 30 days of non-payment, you may receive a Pay-Up Notice. If payment is not made within 5 days, you may be locked out. After 45–60 days, Management may enforce its lien and sell or dispose of stored property per Texas law.
Collection Costs: Management may recover reasonable attorneys’ fees, court/arbitration costs, and collection expenses from you.
10. Termination & Vacating
Notice: You must provide 30 days’ written notice before vacating.
Move-Out: Remove all property, leave the unit broom-clean and undamaged, and remove your lock. Failure to do so may result in charges or deduction from your deposit.
No Partial Refunds: No refunds for partial months or unused days after move-out.
11. Dispute Resolution (Arbitration)
To the fullest extent permitted by Texas law, all disputes arising out of or relating to your tenancy, the facility, or these T&C shall be resolved exclusively by binding arbitration in Harris County, Texas, under rules similar to those described in your Agreement. You and Management waive any right to a trial by jury or to participate in any class action.
12. Notices & Communications
Management may provide notices, invoices, and other communications by email, text, mail, or through the online portal, using your last provided contact information. You are responsible for keeping your contact details current.
13. Modifications to Services and T&C
We may modify, suspend, or discontinue any part of the website or Services at any time, with or without notice. We may also update these T&C from time to time. Changes are effective when posted on our website or otherwise communicated to you. Your continued use constitutes acceptance.
14. Governing Law
These T&C are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
